SSDI Appeals Process

There are deadlines after being denied. In general, you only have 60 days to file an appeal, so you must act quickly. The following are the basic steps in an SSDI appeals process:

  • Request for reconsideration: This is the first step in the appeals process and is simply requesting the Social Security Administration to re-evaluate your application.
  • Requests for hearing before an administrative law judge: The next step is to request a hearing before an administrative law judge. This is an actual appeal before a judge. We will represent you at this hearing.
  • Appeals Council: If you are denied at the administrative hearing, the next phase is to appeal to the Social Security Administration’s Appeals Council.
  • Federal appeal: The final phase is filing appeals in the federal court system: United States District Court, United States of Appeals and the United States Supreme Court, if necessary.
