Georgia SSI Disability Benefits Claim Lawyer

What you are entitled to when you file for disability benefits:

I. SSI, Supplemental Security Income

Under the federal regulations governing the payment of SSI benefits to blind and disabled people, you may be eligible to receive a maximum monthly check of $603 for individuals and $904 for couples. You will also receive non-cash benefits such as Medicaid health care.

SSI eligibility requirements include medical proof of a qualifying disability, as well as proof of limited financial resources.

II. Social Security Disability Insurance (SSDI)

The amount of disability benefits you receive from the SSDI program will be determined by the amount of tax dollars you have paid into FICA, determined by quarterly payments. You may earn up to four quarters of coverage in a twelve month period. You may be eligible for credited earnings up to $970 per calendar quarter, with a total four-quarter amount capped at $3,880.

If you are blind and receiving SSI benefits, special exemptions apply for combining your benefits.

III. Long-term disability benefits

Long-term disability benefits you receive from your qualified pension plan will be governed by the rules of the ERISA Act and will depend upon your pension contribution policies. Benefits you receive from your corporation's long-term disability insurance carrier will affect the amount of benefits you receive from SSDI. Private long-term disability insurance plans typically cover workers up to a percentage amount of their income. You have the right to obtain specific plan payment information from your plan administrator.

Worker's compensation disability benefits

In Georgia, employers are required to carry worker's compensation insurance on all of their exempt and non-exempt employees. The amount of benefits is determined as a percentage of your monthly income, capped at a maximum payment period of 400 months. In addition to cash benefits, you may also be entitled to direct payments for medical services, which have no cap on a time period or dollar amount. Your worker's compensation payments typically will not offset benefits you may be eligible to receive from SSDI.
