What should I know about war-related injuries and SSD claims?

Georgia has many military veterans who provided service to their country and went to dangerous areas as part of their duties. Unfortunately, some of these brave men and women suffered war-related injuries. In some cases, these veterans’ injuries were so severe that they are unable to work. This is when it is important to understand how the Social Security Administration handles veterans and Social Security disability.

While many veterans have sufficient injuries to have their SSD claims approved, some are eligible for expedited processing. This applies to those who are deemed as having a VA compensation rating of 100 percent permanent and total. If the person has been classified as such, it does not automatically mean they will be approved for SSD benefits. They must be found disabled to get the benefits. That means they cannot perform substantial work due to their injuries, illness or condition; and their medical condition has lasted or is expected to last for at least 12 months or result in death.

People who have the 100 percent classification can get expedited processing on their claim meaning that the decision and their benefits will come more rapidly than they normally would. In general, the SSA will immediately identify these veterans. In some cases, the applicant might need to inform the SSA of his or her status. The notification letter of their 100 percent status from the VA can be provided to prove it. There are several factors as to how long the decision will taking including the disability itself, the amount of time it takes to get the medical evidence and if the person must take part in a special medical examination.

While expedited processing is beneficial to Wounded Warriors, there are other important points to being approved for Social Security disability benefits. The evidence is key. So too is it vital to file the application properly. Often, claims are denied not because the person was able to work, but due to clerical errors. Having legal assistance from a law firm that understands SSD and can help with a veterans’ disability claim is a sound way to have a good chance at expedited approval.
